Intellectual Property Licensing

A client with a valuable patent, trademark, or copyright can choose to license that technology to another company for regular royalty payments or for a flat fee. Licensing provides companies of all sizes the opportunity to protect their technological advantage, generate new revenue, and build partnerships with other innovative companies. Smaller companies may decide to specialize on research and development and license out their patents for other companies to produce. Larger companies frequently find themselves with valuable patents no longer relevant to their own business, and license out their intellectual property.

To help clients maximize the value of their current IP assets, we can assist clients in establishing licensing programs, patent and technology transfer ventures, service businesses and software or data licensing initiatives for multiple distribution channels. We can work with you to establish royalty values, identify key patents and analyze possible and pending infringement actions. Many licensing programs are built around instances of known infringement.

Once a program is established, we actively participate in the licensing process and help clients resolve any infringement cases that may arise. We seek the optimal outcome for our clients through negotiation, litigation or a combination of the two.

We can also help create cross-licensing schemes to help prevent expensive court battles and litigation. Cross-licensing is the mutual sharing of intellectual property between companies without an exchange of license fee if both intellectual property portfolios are about equal in value.
